Welcome to This n That Consignments. These terms apply to thisnthatconsign.com and to purchases made through our online store. By using the site or placing an order, you agree to them. If you do not agree, please do not use the site.
Who we are
This n That Consignments, LLC is an Ohio limited liability company. We are a consignment retailer of furniture, home decor, housewares, and boutique clothing and accessories, with three stores: 753 Reading Rd. and 763 Reading Rd. in Mason, Ohio, and 548 Miamisburg Centerville Rd. in Centerville, Ohio. We sell items on behalf of consignors. These terms cover shoppers. Consignors are covered by a separate consignment agreement at drop-off.
Secondhand goods, sold as-is
Everything we sell is pre-owned unless clearly stated otherwise. Items are sold as-is, where-is, with all faults. We do our best to describe each item accurately and photograph any notable wear, but we do not inspect items to any professional standard and we make no promises about age, origin, authenticity, materials, brand, or structural condition beyond what is stated. Colors may look different on screen. Measurements are approximate. You are welcome to come see any item in person before buying.
No warranties
To the fullest extent allowed by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing on this site should be relied on as a guarantee about any item.
Pricing and availability
Items are one of a kind and also for sale in our physical stores. An item may sell in store before your online order is processed. If that happens, we will cancel your order and refund you in full. We reserve the right to correct pricing errors, typos, or incorrect descriptions, and to cancel any order affected by them, even after it is confirmed.
Orders, payment, and taxes
An order is accepted when we send a confirmation. We may refuse or cancel any order at our discretion. Prices are in U.S. dollars. Applicable Ohio sales tax is added at checkout.
Pickup and delivery
Most items are available for local pickup at the store where they are located. Pickup windows and any delivery options and fees are shown at checkout or arranged with the store. Items not picked up within 14 days of purchase may be returned to the sales floor and the order refunded, minus any fees stated at checkout. Once an item leaves the store, risk of loss passes to you. If you arrange your own mover or carrier, we are not responsible for damage that occurs after pickup.
Returns
All sales are final. Because our inventory is consigned, we cannot accept returns, exchanges, or refunds on the basis of condition, fit, or change of mind. The exceptions are orders we cancel (sold in store, pricing error) and items materially different from their description, which you must report to us within 3 days of pickup so we can make it right.
Limitation of liability
To the fullest extent allowed by law, This n That Consignments, LLC and its owners, employees, and consignors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the site or any item purchased. Our total liability for any claim related to an order is limited to the amount you paid for that order. Some states do not allow certain limitations, so some of these may not apply to you.
Your use of the site
You agree not to misuse the site, attempt to access it in unauthorized ways, scrape it, or use it for anything unlawful. Site content, photos, and branding belong to us or our licensors and may not be copied without permission. We may modify or discontinue any part of the site at any time.
Privacy
Our Privacy Policy explains how we handle your information. Third-party services such as Shopify and payment processors have their own terms.
Indemnification
You agree to hold This n That Consignments, LLC harmless from any claims, damages, or costs arising from your breach of these terms or your misuse of the site or of an item you purchased.
Governing law and disputes
These terms are governed by the laws of the State of Ohio. Any dispute will be handled in the state or federal courts located in Warren County, Ohio, and you consent to that jurisdiction.
Changes
We may update these terms at any time by posting a new version here. Continued use of the site after a change means you accept it.
